What is the Anishinabek Nation Governance Agreement?

The Anishinabek Nation Governance Agreement (ANGA) is a self-government agreement that recognizes four law-making powers:

  • Elections
  • Citizenship
  • Language and Culture
  • Operation of Government

 

What is the Anishinabek Nation Fiscal Agreement?

The Anishinabek Nation Fiscal Agreement (ANFA) outlines the financial support that will help First Nations to pass those laws and to operate governance practices that can better address community issues.

The fiscal offer includes a global amount about seven times higher than the existing governance funding under the Indian Act.

It also contains one-time implementation funding to help Anishinabek First Nations who ratify the ANGA to transition out of the Indian Act sections relating to governance activities. The transitional funding will help First Nations to:

  • Develop the laws recognized under the ANGA
  • Set up new governance systems
  • Communicate and consult with their citizens
  • Complete transition-related training of staff

The fiscal agreement will help ensure Anishinabek First Nations can make improvements to their governance systems as they see fit, including initiatives to strengthen the use of Anishinaabemowin and cultural ceremonies if they want to.

Canada will not dictate how the funds are spent.

This document describes the Anishinabek Nation Fiscal Agreement (ANFA) in plain language. This is an   explanative tool and does not form part of the legal arrangements propose between the parties. This is not a legal document and does not serve as a legal interpretation of the Anishinabek Nation Fiscal Agreement.

PREAMBLE

The Preamble contains statements by each Party concerning their intent in entering the Anishinabek Nation Governance Agreement (ANGA) and their intent to maintain a financial relationship for the purposes of the ANGA. The Preamble is not legally enforceable. Everything that is included in the ANFA after the Preamble is legally enforceable for the Anishinabek Nation and for Canada (the Parties to the ANFA)

DEFINITIONS AND INTERPRETATION

The definitions in the ANGA apply in the Anishinabek Nation Fiscal Agreement (ANFA). There are also additional definitions that apply only within the AN

This Interpretation section provides guidance to the reader on how to read and interpret the ANFA.

TERM

The term of the ANFA is five (5) years from the date the ANFA becomes effective. This Part also explains the process for any subsequent fiscal agreements. This Part also outlines the intent of the Parties to amalgamate the fiscal agreements for the ANGA and the Anishinabek Nation Education Agreement into a single fiscal agreement.

AMENDMENT

This Part describes the process to amend the ANFA. It can only be amended by the Parties according to the process outlined in this Part and in writing.
